Welcome to Chunar Digital Media, also known as CDMedia (“CDMedia”, “we”, “our”, or “us”). These Terms & Conditions govern your access to and use of our website, dashboard, music distribution services, royalty-related services, content management support, and any other services provided by CDMedia through cdmedia.in or any associated platform.
By accessing our website, creating an account, submitting content, making payment, signing an agreement, or using any service provided by CDMedia, you agree to be bound by these Terms & Conditions.

Chunar Digital Media is not currently incorporated as a private limited company, LLP, or registered company under the Companies Act. It is operated as an individually owned music distribution and digital media service business by Suraj Kumar.
2. Acceptance of Terms
By using CDMedia’s website, dashboard, distribution services, royalty services, or any related support service, you confirm that:
- You have read, understood, and accepted these Terms & Conditions.
- You are legally capable of entering into an agreement.
- All information, documents, content, audio files, artwork, and rights declarations submitted by you are true, accurate, original, and legally valid.
- You accept full responsibility for the content submitted by you or on behalf of your label, artist, distributor account, or business entity.
If you do not agree with these Terms, you must not use our website, dashboard, or services.
3. Services Provided by CDMedia
CDMedia may provide services including, but not limited to:
- Music distribution to digital streaming platforms.
- YouTube music-related services.
- Artist, label, and distributor dashboard access.
- Royalty reporting and payment support.
- Music catalog management.
- Copyright support and content protection assistance.
- YouTube Content ID, CMS/MCN-related support, OAC, caller tune, and other music-related digital services, where available.
- Administrative support for labels, artists, and distributors.
Availability of any service may depend on eligibility, platform rules, internal approval, third-party policies, and agreement terms.
CDMedia reserves the right to accept, reject, hold, remove, suspend, or stop any service at its sole discretion if the content, account, or user activity violates these Terms, platform policies, copyright law, or any applicable law.
4. User Categories
CDMedia may provide services to different types of users, including:
- Independent artists.
- Music labels.
- Distributors.
- Producers.
- Content owners.
- Rights holders.
- Business partners.
All users are bound by these Terms, regardless of account type.
5. Account and Dashboard Access
CDMedia may provide dashboard access to users after approval, verification, agreement completion, or payment, as applicable.
You are responsible for:
- Maintaining the confidentiality of your login details.
- Ensuring that no unauthorized person uses your dashboard.
- Submitting only accurate and legal content.
- Keeping your contact, bank, KYC, and tax details updated.
- Immediately informing CDMedia in case of unauthorized dashboard access.
CDMedia may suspend, restrict, or terminate dashboard access if:
- False information is submitted.
- Copyright infringement is found or alleged.
- Reused, AI-generated, unauthorized remix, stolen, fraudulent, or misleading content is submitted.
- KYC or agreement documents are incomplete or invalid.
- The user violates these Terms or any platform policy.
- There is suspicious, illegal, abusive, or fraudulent activity.
6. KYC and Agreement Documents
To complete the onboarding, verification, and agreement process, CDMedia may collect the following documents and information:
- Aadhaar Card.
- PAN Card.
- Mobile Number.
- Email ID.
- Bank Passbook or bank account proof.
- Address details.
- Artist, label, or distributor details.
- Signature, agreement copy, and any other supporting document required for verification.
By submitting these documents, you confirm that they are genuine, valid, and belong to you or your authorized entity.
CDMedia may reject or suspend any account if the submitted documents are incomplete, false, mismatched, forged, expired, misleading, or legally invalid.
7. Content Ownership and Originality Policy
CDMedia follows a strict original-content-only policy.
We do not accept, distribute, promote, or monetize any content that falls under the following categories:
- Reused content.
- Stolen content.
- Unauthorized remix songs.
- Unauthorized mashups.
- Unauthorized recreated songs.
- Unauthorized cover songs.
- Unauthorized DJ mixes.
- Unauthorized devotional, folk, film, or private catalog reuse.
- Content copied from YouTube, social media, streaming platforms, or any third-party source.
- AI-generated songs, AI-generated vocals, AI-generated compositions, or AI-generated music where rights, authorship, ownership, and legality are not fully clear.
- Content that violates copyright, neighboring rights, publishing rights, master rights, performer rights, moral rights, trademark rights, privacy rights, or any third-party rights.
CDMedia distributes only original songs where the user has full legal ownership, permission, license, or authorization.
8. Remix, Cover, and Derivative Content
CDMedia does not accept unauthorized remix songs.
If any artist, label, distributor, or user submits a remix, cover, recreated version, adaptation, derivative work, or modified version of an existing song, the user must have:
- Valid written permission from the original rights holder.
- Master rights authorization, where applicable.
- Publishing rights authorization, where applicable.
- Mechanical license, synchronization license, or any other license required by law or platform policy.
- Original project files, stems, sessions, or proof of production, if required.
- Legal documents proving that the user has the right to distribute and monetize the content.
If the user cannot provide valid rights documents, CDMedia may reject, remove, suspend, or block the content and may also suspend the user’s dashboard.
9. AI-Generated Content Policy
CDMedia does not distribute AI-generated songs or AI-generated music content unless CDMedia gives written approval and the user provides complete legal proof of ownership, rights, originality, consent, and compliance with all applicable platform rules and laws.
Users must not submit:
- AI-generated songs without clear rights.
- AI-generated vocals imitating real artists or public figures.
- AI-generated music using unauthorized datasets.
- AI-generated content that may create copyright, personality rights, performer rights, or moral rights conflicts.
- AI-assisted content where ownership and licensing cannot be proven.
CDMedia reserves the right to reject any AI-related content at its sole discretion.
10. Copyright Infringement and Conflict Policy
If any song, artwork, metadata, artist name, label name, audio file, video, or other content submitted by a user creates any copyright infringement, ownership conflict, legal notice, platform claim, copyright strike, Content ID conflict, royalty dispute, or third-party complaint, the user must provide valid proof of rights within 24 hours of CDMedia’s request.
The required proof may include:
- Agreement copy.
- NOC from rights holder.
- License certificate.
- Original project file.
- Studio session file.
- Composer/lyricist/singer/producer authorization.
- Publishing rights document.
- Master rights document.
- Payment proof related to rights purchase.
- Any other document required by CDMedia or the concerned platform.
If the user fails to provide valid documents within 24 hours, CDMedia may:
- Suspend the user’s dashboard.
- Stop distribution of the disputed content.
- Hold royalty payments.
- Hold payments for all songs connected to the same account, label, artist, or distributor.
- Reject future releases.
- Remove or restrict account access.
- Terminate the service agreement.
- Take any action required to protect CDMedia, platforms, partners, and rightful owners.
CDMedia will not be responsible for any loss, claim, strike, penalty, legal notice, platform penalty, royalty deduction, or damages caused by content submitted by the user.
11. User Responsibility for Content
The user is fully responsible for all content submitted to CDMedia.
By submitting content, you confirm that:
- You own or legally control all rights in the content.
- The audio is original or legally licensed.
- The artwork is original or legally licensed.
- The metadata is accurate.
- The artist, composer, lyricist, producer, label, and contributor details are correct.
- No third-party rights are violated.
- The content does not contain illegal, hateful, abusive, defamatory, obscene, misleading, or harmful material.
- You will fully indemnify CDMedia against any claim arising from your content.
CDMedia may request proof of ownership at any time, before or after distribution.
12. Revenue Share Model
CDMedia works on both percentage-based and plan-based models.
If a user, artist, label, or distributor earns more than USD 500 per month from YouTube, streaming platforms, or other monetized platforms, CDMedia may work with that user on an 80/20 revenue-share model, where:
- 80% of net revenue belongs to the user.
- 20% of net revenue belongs to CDMedia.
“Net revenue” means the amount actually received by CDMedia after deduction of platform fees, distributor fees, taxes, chargebacks, refunds, bank charges, currency conversion charges, withholding taxes, claim deductions, third-party deductions, and any other applicable deductions.
CDMedia reserves the right to verify monthly revenue before approving the 80/20 model.
13. Plan-Based Model
If a user does not have monthly revenue above USD 500 but still wants to distribute music through CDMedia, CDMedia may offer a plan-based model.
The standard plan may include:
- One-time payment of ₹899, unless changed or updated by CDMedia.
- Dashboard access after successful payment and approval.
- 100% royalty share to the user, subject to actual net revenue received from platforms and applicable deductions.
“100% royalty” means 100% of the net royalty actually received for the user’s content after applicable platform deductions, taxes, bank charges, currency conversion charges, claim deductions, withholding taxes, and any third-party deductions.
CDMedia may revise plan pricing, benefits, features, and eligibility at any time.
14. No Refund Policy
Once the user makes payment and dashboard access is activated, CDMedia does not provide any refund.
No refund will be provided in the following cases:
- The user changes their mind.
- The user does not submit content.
- The user submits rejected content.
- The user violates content guidelines.
- The user submits reused, AI-generated, stolen, remix, or infringing content.
- The user’s account is suspended.
- The user fails to complete KYC or agreement.
- The user requests cancellation after dashboard activation.
- Platform approval is delayed or denied due to user content or platform policy.
- The user requests takedown during the agreement term.
By making payment, the user agrees that the payment is final and non-refundable after dashboard activation.
15. Royalty Payment Policy
CDMedia pays royalties only after receiving confirmed revenue from platforms, partners, or relevant monetization sources.
For labels and users, the first payment will generally be made after three months, subject to:
- Revenue being received by CDMedia.
- Correct KYC completion.
- Valid bank details.
- No copyright conflict.
- No ownership dispute.
- No pending agreement issue.
- No suspicious or fraudulent activity.
- No platform hold or deduction.
After the first payment cycle, CDMedia generally pays royalties at the end of every month.
Payments may be delayed due to:
- Festivals.
- Banking holidays.
- Saturday or Sunday.
- Platform reporting delays.
- Payment gateway or bank processing delays.
- Revenue hold by platforms.
- Copyright disputes.
- Account verification issues.
- Technical or administrative reasons.
CDMedia will not be liable for reasonable delays caused by banks, platforms, third-party services, holidays, compliance checks, or disputes.
16. Royalty Hold and Forfeiture in Case of Violation
If any user submits infringing, reused, unauthorized, AI-generated, remix, stolen, fake, fraudulent, or disputed content, CDMedia may hold royalty payments.
CDMedia may hold:
- Royalty of the disputed song.
- Royalty of all songs under the same account.
- Royalty of all songs under the same label.
- Royalty of all songs under the same artist or distributor profile.
- Any pending payment until the dispute is fully resolved.
If a claim, penalty, legal cost, platform deduction, refund, or third-party liability arises due to the user’s content, CDMedia may adjust such amount from the user’s royalty.
No payment will be released while a copyright, ownership, fraud, or legal dispute is pending.
17. Five-Year Agreement Policy
CDMedia’s standard agreement period is a minimum of five years, unless otherwise agreed in writing.
During the five-year agreement period:
- The user cannot demand voluntary takedown of distributed songs before completion of the agreement term.
- CDMedia is not obligated to remove songs only because the user later changes their decision.
- The user must respect the agreement period.
- The user cannot transfer the same content to another distributor in a way that creates duplicate delivery, conflict, copyright claim, revenue conflict, or platform dispute.
After completion of the five-year agreement period, the user may request takedown as per the agreement terms.
After the agreement expires, CDMedia may process takedown requests, subject to:
- Written request from the authorized user.
- No pending royalty dispute.
- No pending copyright claim.
- No unpaid dues.
- Platform processing timelines.
- Third-party distributor or platform rules.
CDMedia may still remove or takedown content during the agreement period if required by law, platform policy, copyright claim, legal notice, fraud investigation, or internal compliance requirement.
18. Takedown Policy
CDMedia does not guarantee immediate takedown from all platforms.
Takedown depends on:
- Platform rules.
- Third-party distributor timelines.
- Store processing time.
- Copyright status.
- Agreement terms.
- Pending royalty or legal issues.
Once a takedown request is accepted and processed, some platforms may still keep cache, metadata, preview, search results, user-generated content, or historical reporting for a certain period. CDMedia is not responsible for platform-side delay after submitting a valid takedown request.
19. Metadata, Artwork, and File Submission
The user must submit accurate and professional metadata, including:
- Song title.
- Artist name.
- Singer name.
- Lyricist name.
- Composer name.
- Producer name.
- Label name.
- Language.
- Genre.
- Release date.
- Copyright and publishing details.
- Artwork.
- Audio file.
- Any other required information.
The user is responsible for ensuring that the audio file, artwork, and metadata do not violate any third-party rights.
CDMedia may reject content if:
- Metadata is incorrect.
- Artwork is poor quality or infringing.
- Audio quality is unacceptable.
- Rights are unclear.
- Artist or label names are misleading.
- Content violates platform rules.
- Content appears reused, AI-generated, infringing, or suspicious.
20. Platform Approval
Submitting content to CDMedia does not guarantee approval by digital streaming platforms, YouTube, Content ID systems, caller tune platforms, or any other third-party platform.
Platforms may reject, delay, block, remove, demonetize, mute, restrict, or claim content according to their own policies.
CDMedia is not responsible for third-party platform decisions.
21. Service Delays
CDMedia will try to provide services professionally and within a reasonable time. However, delays may occur due to:
- Platform processing.
- Verification.
- KYC review.
- Agreement review.
- Copyright checks.
- Banking issues.
- Festival holidays.
- Weekends.
- Technical issues.
- Third-party service delays.
No compensation or refund will be provided only because of reasonable service delays.
22. User Prohibited Activities
Users must not:
- Submit stolen or copied content.
- Submit reused content.
- Submit unauthorized remixes.
- Submit AI-generated songs without approval.
- Submit fake documents.
- Submit fake artist or label details.
- Misuse dashboard access.
- Attempt to manipulate royalties.
- Create duplicate accounts to avoid suspension.
- Upload content that violates copyright law.
- Threaten, abuse, or harass CDMedia staff or partners.
- Use CDMedia services for illegal, fraudulent, misleading, or harmful activities.
Violation of these rules may result in account suspension, royalty hold, termination, and legal action.
23. Account Suspension and Termination
CDMedia may suspend or terminate any account without refund if:
- The user violates these Terms.
- Copyright infringement is reported.
- False KYC is submitted.
- Payment fraud is detected.
- The user submits prohibited content.
- The user fails to provide rights documents within 24 hours when requested.
- The user misuses dashboard access.
- The user creates legal, financial, or reputational risk for CDMedia.
- The user violates platform policies.
- The user behaves abusively or fraudulently.
During suspension, dashboard access, royalty withdrawal, release submission, service requests, and support access may be restricted.
24. Indemnity
The user agrees to fully indemnify and hold harmless CDMedia, Suraj Kumar, team members, partners, distributors, service providers, and associated parties from and against any claim, demand, loss, penalty, damage, liability, legal cost, platform penalty, copyright claim, royalty dispute, or third-party complaint arising from:
- Content submitted by the user.
- False ownership claims.
- Copyright infringement.
- Unauthorized remix or reused content.
- AI-generated or fraudulent content.
- Incorrect metadata.
- Fake documents.
- Breach of agreement.
- Violation of law or platform policy.
- Misuse of CDMedia services.
25. Limitation of Liability
CDMedia will not be liable for:
- Platform rejection or delay.
- Revenue fluctuations.
- Content removal by platforms.
- Copyright claims caused by user content.
- Loss of revenue due to platform policy.
- Bank or payment delays.
- Third-party deductions.
- Account suspension caused by user violation.
- Technical errors beyond CDMedia’s reasonable control.
- Any indirect, incidental, consequential, or special damages.
CDMedia’s maximum liability, if any, shall not exceed the amount paid by the user to CDMedia for the specific service giving rise to the claim, unless otherwise required by law.
26. Communication
CDMedia may communicate with users through:
- Email.
- Phone.
- WhatsApp.
- Dashboard notifications.
- Website notices.
- Written agreement.
- Any other official communication channel used by CDMedia.
The user is responsible for checking communication regularly and responding within the required timeline.
27. Changes to Services and Terms
CDMedia may update, modify, suspend, discontinue, or change any service, plan, pricing, policy, or term at any time.
Updated Terms will be posted on the website. Continued use of CDMedia’s services after such updates means that the user accepts the revised Terms.
28. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and interpreted according to the laws of India.
Any dispute arising from or related to CDMedia, its services, agreements, payments, content, dashboard access, or these Terms shall be subject to the jurisdiction of competent courts located in Uttar Pradesh, India, unless otherwise required by applicable law.
